Types of Domestic Violence
Three forms of domestic violence exist in Texas—domestic assault, aggravated domestic assault, and continuous violence against the family.
Any violence committed against a family member is domestic violence, including:
- A current or former spouse
- A child of a current or former spouse
- A person with whom the offender has a child
- A foster child or foster parent of the offender
- A family member of the offender by blood, marriage, or adoption
Domestic assault is a misdemeanor and carries consists of:
- Intentionally, knowingly, or recklessly causing bodily injury to another person
- Threatening another with bodily injury, or
- Intentionally provoking another
Aggravated domestic assault involves causing serious bodily injury or using a deadly weapon while committing a crime or provoking another. This crime is a first degree felony which carries 5 to 99 years in prison and up to $10,000 in fines.
